What Are Homeowner Associations?

What Are Homeowner Associations?  A Homeowners Association (HOA) is a private organization established within a residential community—such as a subdivision, planned development, or condominium building—to create and enforce rules for properties and residents. HOAs are typically governed by a board of directors elected by the homeowners and are responsible for maintaining common areas, managing community amenities, and upholding property values.

What a Mandatory HOA Could Mean for You

Once an HOA is created, a small board gains legal authority over your property. This is not the same as our Maintenance Committee. Here’s what could happen:

1️⃣ Property Restrictions: Limits on animals, buildings, vehicles, or other property uses. New rules can be added at the board’s discretion.

2️⃣ Mandatory Fees & Assessments Yearly dues can increase without owner approval.“Special assessments” can be charged for projects you may disagree with.

3️⃣ Fines & Liens Violations can result in fines. Unpaid dues or fines may turn into a lien, even leading to foreclosure.

4️⃣ Permanent Legal Authority Once recorded, it’s extremely difficult to remove an HOA. Future owners are automatically bound to all HOA rules.
